TERMS AND CONDITIONS

for Ordering, Purchase and Delivery of Goods

Effective date: 16 November 2025

This Public Offer Agreement (the “Agreement”) constitutes an official and public offer made by SUCHKA Sp. z o.o. (hereinafter referred to as the “Seller”) to enter into a distance sales contract for goods offered on the website:

www.suchka.shop (the “Website”).

This Agreement sets out the terms and conditions under which the Seller sells and delivers goods to customers.

By placing an order on the Website, the Buyer confirms that they have read, understood, and accepted the terms of this Public Offer.

The Agreement is considered concluded at the moment the Buyer clicks the “Confirm Order” button during checkout and receives confirmation of the order from the Seller.

1. Definitions

1.1 Public Offer
A public proposal made by the Seller to an unlimited number of persons to conclude a distance sales contract for goods under the conditions set out in this Agreement.

1.2 Goods
Products presented on the Website that may be purchased by the Buyer.

1.3 Online Store
The website located at www.suchka.shop, through which retail sales contracts are concluded remotely via the Internet.

1.4 Buyer
A natural person who is at least 18 years old, purchasing goods for personal use, or a legal entity placing an order through the Website.

1.5 Seller
SUCHKA Sp. z o.o., a company registered and operating under the laws of Poland.

2. Subject of the Agreement

2.1 The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods in accordance with the terms of this Agreement.

2.2 The Agreement is considered concluded when the Buyer completes the order form on the Website and the Seller confirms the order electronically.

3. Placing an Order

3.1 The Buyer places an order independently through the Website using the Cart functionality.

3.2 The Seller reserves the right to refuse an order if the information provided by the Buyer is incomplete or inaccurate.

3.3 When placing an order the Buyer must provide:

  • full name
  • delivery address
  • email address
  • contact phone number

3.4 The Buyer is responsible for the accuracy of the information provided.

3.5 By placing an order, the Buyer confirms that:

  • they have read and accepted this Agreement;
  • they are at least 18 years old;
  • they consent to the processing of personal data according to the Privacy Policy.

4. Price and Payment

4.1 Prices for Goods are indicated on the Website in EUR and include VAT where applicable.

4.2 The Seller reserves the right to change prices unilaterally. Price changes do not affect orders already confirmed.

4.3 Payment must be completed before the order is processed.

4.4 Available payment methods are indicated on the Website.

5. Delivery

5.1 Delivery of Goods is carried out through international postal and courier services.

5.2 Delivery times depend on the destination country and are specified in the Shipping Policy.

5.3 Shipping costs are calculated during checkout and paid by the Buyer.

5.4 Ownership of the Goods transfers to the Buyer upon delivery of the Goods to the Buyer or the carrier.

6. Returns

6.1 Consumers have the right to withdraw from the purchase within 14 days in accordance with Directive 2011/83/EU on Consumer Rights.

6.2 For hygiene reasons, the right of withdrawal does not apply to the following goods once their packaging or protective seal has been opened:

  • underwear
  • lingerie
  • hosiery
  • corsetry products
  • other intimate apparel.

6.3 Detailed return conditions are described in the Return & Refund Policy.

7. Liability

The Parties shall not be liable for failure or delay in fulfilling their obligations if such failure results from force majeure circumstances, including but not limited to:

  • natural disasters
  • war
  • government restrictions
  • technical failures beyond reasonable control.

8. Personal Data

Personal data is processed in accordance with the Privacy Policy and the General Data Protection Regulation (GDPR).

9. Governing Law

This Agreement is governed by the laws of Poland and applicable European Union legislation.
